Violating these policies may result in service termination by the provider, and ProfitHound assumes no liability for such actions.

You agree to comply with all applicable laws, regulations, and third-party service policies, including but not limited to:

• Messaging and telecommunications compliance rules for SMS campaigns.
• Ringless Voicemail guidelines for voicemail campaigns.
• Email Sending Policy & CAN-SPAM compliance for email outreach.
• AI Call Compliance Requirements for automated voice calls.
• Third-party automation service terms when connecting with external apps.

Prohibited Activities:

• Sending unsolicited marketing messages (spam) without prior consent.
• Engaging in fraudulent, deceptive, or misleading communication.
• Using ProfitHound to promote illegal products or services.
• Bypassing or manipulating service restrictions imposed by third-party providers.

4. User Responsibilities & Compliance

You agree that:

• You have obtained proper consent before sending messages to recipients.
• You will honor opt-out requests immediately by removing users from future outreach.
• You are solely responsible for ensuring that your campaigns comply with TCPA, GDPR, CAN-SPAM, and other applicable laws.

ProfitHound does not provide legal advice and assumes no responsibility for non-compliant campaigns conducted by users.

5. Third-Party Services Disclaimer

ProfitHound depends on third-party service providers for messaging, automation, and outreach functionality. These providers may update their terms, restrict services, or suspend accounts at their discretion. Users are responsible for ensuring their campaigns comply with each provider’s policies. ProfitHound is not liable for any interruptions, suspensions, or restrictions imposed by third-party services.

ProfitHound integrates with third-party services, but:

• We do not control the performance, reliability, or availability of these services.
• If your account is suspended or terminated by a third-party provider due to policy violations, ProfitHound is not responsible for the impact on your campaigns.
• ProfitHound reserves the right to disable integrations or restrict usage if a provider enforces policy changes affecting our platform.

6. Payment & Subscription Terms

• Subscription Plans: ProfitHound operates on a recurring subscription model with different pricing tiers based on usage.
• Billing Cycle: Payments are due monthly or annually, depending on your selected plan.
• Refund Policy: All payments are non-refundable, except in cases where ProfitHound fails to deliver the agreed-upon service.
• Account Suspension for Non-Payment: If payment is not received, ProfitHound may suspend or terminate your account until payment is made.

7. Limitation of Liability

ProfitHound does not guarantee the availability, deliverability, or performance of third-party communication services. Users acknowledge that if a provider suspends or terminates their access due to violations of its policies, ProfitHound is not responsible for any resulting impact on the user’s business or campaign performance.

• ProfitHound does not guarantee message deliverability, as this depends on third-party services.
• ProfitHound is not liable for any lost revenue, legal consequences, or damages arising from improper use of the platform.
• You agree that ProfitHound’s maximum liability shall not exceed the amount paid for the service in the last 3 months.

8. Modifications & Termination

• ProfitHound may update these Terms of Service at any time, with notice provided via email or website updates.
• If you continue to use ProfitHound after an update, you agree to the revised terms.
• ProfitHound reserves the right to terminate access to any user who violates these terms.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA. Any disputes shall be resolved through binding arbitration in Miami Beach, FL, unless both parties agree to an alternative method.
